Membership Agreement

By activating a membership, hosting plan, or other subscription service offered by Launch Common, LLC ("Common," "we," "our," or "us"), you agree to the terms outlined in this Membership Agreement.

This agreement explains how our services operate, what is included with your membership, and the responsibilities of both Common and our members.

Membership Subscription

Common operates on a recurring subscription model that automatically renews until canceled.

To activate a subscription, you may be required to provide:

  • Full Name
  • Email Address
  • Phone Number
  • Billing Address
  • Payment Information

Membership benefits vary by plan but may include:

  • Complimentary Website Sprint
  • Website Hosting
  • Website Management
  • Website Updates
  • Technical Maintenance
  • Website Monitoring
  • Additional services or benefits associated with your selected plan

Digital Signature Acknowledgement

Before activating a subscription, you may be asked to provide a digital signature by entering your legal name.

You acknowledge and agree that this digital signature serves as your legally binding signature and indicates your acceptance of this Membership Agreement.

Complimentary Website Sprint

Most Common memberships begin with a complimentary website sprint.

The website sprint is provided without design fees, upfront deposits, or setup charges.

Website sprints currently support:

  • Up to 5 pages
  • One round of simple revisions
  • Informational websites
  • Standard contact forms
  • Basic integrations
  • Custom domains
  • Mobile-friendly layouts

The following are not included:

  • Ecommerce websites
  • Custom web applications
  • Membership platforms
  • Marketplaces
  • Advanced custom development
  • Complex integrations outside our supported platforms

We reserve the right to determine whether a requested feature falls within the scope of our services.

Website Launch Timeline

Our goal is to complete most website sprints within approximately 7 business days.

Launch timelines depend heavily on communication and content delivery from the member.

Delays in providing content, approvals, feedback, or requested information may result in delays to the launch timeline.

Launch dates are estimates and are not guaranteed.

Website Content Guidelines

Members may only provide content they own or have permission to use.

The following content is prohibited:

  • Illegal content
  • Copyright-infringing content
  • Adult or sexually explicit content
  • Hate speech or discriminatory content
  • Violent or graphic content
  • Tobacco, vaping, cannabis, or illegal drug promotion
  • Multi-level marketing schemes
  • Get-rich-quick programs
  • Excessive advertising or spam
  • File-sharing services
  • Any content our team determines to be inappropriate or harmful

Common reserves the right to refuse service or remove content that violates these guidelines.

Website Hosting

Website hosting is included through an active hosting subscription.

Hosting is required for your website to remain online.

If your hosting subscription is canceled, your website may be taken offline at the conclusion of your current billing cycle.

Common maintains full control over the hosting environment to ensure performance, security, maintenance, and support.

Website Management

Management services are available on plans that include management.

Members may submit website update requests through approved support channels.

While updates may be described as unlimited, all requests are subject to reasonable review, scheduling, prioritization, and approval.

Common reserves the right to decline requests that:

  • Require custom development
  • Fall outside plan limitations
  • Constitute a complete redesign
  • Require third-party services not supported by Common
  • Conflict with this agreement

Estimated turnaround times may vary depending on request volume and complexity.

Website Redesigns

The complimentary website sprint includes the initial website design only.

Requests that significantly alter the appearance, structure, functionality, or overall direction of a completed website may be considered redesign requests.

Redesign requests are not included within standard hosting or management plans and may require a separate agreement.

Additional Services

Common may offer additional services, integrations, or upgrades.

These services may be subject to separate pricing, availability, approval, and terms.

Examples may include:

  • Analytics setup
  • Form integrations
  • Search Console setup
  • Third-party software integrations
  • Additional design work

Domain Names

Custom domains are not included unless otherwise stated.

Members are responsible for purchasing and maintaining their domain registration.

Members may be required to provide access to their domain provider account for connection purposes.

Common does not assume ownership of member-owned domains.

Communication

Email is our primary communication channel.

Meetings may be offered at our discretion but are not included by default.

When meetings are provided, they may be conducted virtually and may be recorded for quality assurance, training, documentation, and internal purposes.

Business Days

Common's standard business days are Monday through Friday.

Weekends and holidays are not considered business days.

Back-End Access

Common is a managed website service and not a do-it-yourself platform.

To maintain security, consistency, and support quality, member access to website back-end systems is generally not provided.

Requests for administrative access may be denied at our sole discretion.

Third-Party Service Providers

If a third-party provider requires access to a website for services such as SEO, accessibility, analytics, or marketing support, Common may provide limited access where appropriate.

Common reserves the right to revoke access at any time.

Failed Payments

If a payment fails, we may attempt to collect payment again and may notify you of the failed transaction.

If payment is not received within a reasonable period, Common may:

  • Suspend services
  • Disable website functionality
  • Take the website offline
  • Terminate the subscription

Accounts that remain unpaid may be permanently removed without notice.

Chargebacks and Payment Disputes

If a payment dispute or chargeback is filed, Common may immediately suspend services and disable the associated website.

If the dispute is not resolved, Common reserves the right to permanently terminate services and remove website access.

We reserve the right to provide documentation supporting the legitimacy of any disputed charges.

Refund Policy

All payments are non-refundable unless otherwise required by law.

This includes:

  • Hosting fees
  • Membership fees
  • Setup fees
  • Add-on services
  • Additional purchases

By subscribing, you acknowledge and accept this no-refund policy.

Intellectual Property

Members retain ownership of their logos, trademarks, text, images, and other content they provide.

Members represent that they possess all necessary rights and permissions to use any content submitted to Common.

Common is not responsible for copyright claims or disputes related to member-provided content.

Portfolio Rights

Unless otherwise requested in writing, Common may display completed websites, screenshots, branding materials, and project details in portfolios, marketing materials, social media content, case studies, or promotional materials.

Opt-Out of Portfolio Usage

Members may request in writing that Common not publicly showcase their website or project.

We will make reasonable efforts to honor such requests.

Website Policies

Members are responsible for providing any legal policies required for their business, including but not limited to:

  • Privacy Policies
  • Terms of Service
  • Refund Policies
  • Cookie Policies

Common does not provide legal advice.

Website Accessibility

Common does not guarantee compliance with accessibility standards or regulations.

Members are responsible for obtaining any accessibility audits, tools, or services required by their business or jurisdiction.

Limitation of Liability

To the maximum extent permitted by law, Common shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

Our total liability shall not exceed the amount paid by the member to Common during the twelve months preceding the claim.

Governing Law

This agreement shall be governed by the laws of the State of California.

Any legal action relating to this agreement shall be brought exclusively in Orange County, California.

Changes to This Agreement

Common may update or modify this Membership Agreement at any time.

Changes become effective immediately upon publication.

Continued use of our services following any updates constitutes acceptance of the revised agreement.
